Terms of Use
The short version
- Vellness helps you keep and understand your health records. It is not a medical device and does not give medical advice.
- Values read from your reports can be wrong. Check them against your originals.
- You are responsible for your account, your content and who you share links with.
- You can delete your account in the app at any time.
1. Acceptance
By creating an account or using the Vellness mobile application (the "Application") and the service it connects to, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use it.
2. The service and licence
The Application is licensed to You (End-User) by Magicanvas, operated by Himanshu Parashar, 5439 Knights Valley Ln, Antioch, California 94531, United States (the "Licensor"), for use only under these terms. By downloading the Application from the Apple App Store, and any update to it, You indicate that You agree to be bound by this agreement. Apple is not a party to this agreement and is not bound by any provisions or obligations with regard to the Application, such as warranty, liability, maintenance and support. Magicanvas, not Apple, is solely responsible for the Application and its content. These terms do not provide usage rules that conflict with the latest App Store Terms of Service. All rights not expressly granted to You are reserved.
You are given a non-transferable, non-exclusive, non-sublicensable licence to install and use the Application on Apple-branded products that You own or control, as permitted by the App Store Terms of Service, including use by other accounts associated with You through Family Sharing or volume purchasing. You may not share, sell, rent, lend, lease or otherwise redistribute the Application, reverse engineer, decompile, modify or create derivative works of it, or remove any intellectual property notices, except as the law allows or with our written consent.
Magicanvas is solely responsible for support for the Application; contact hi@magicanvas.in. If the Application fails to conform to an applicable warranty, You may notify Apple and Apple will refund the purchase price (if any); to the maximum extent the law allows, Apple has no other warranty obligation. Magicanvas, and not Apple, is responsible for addressing claims by You or any third party about the Application or Your use of it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, claims under consumer protection or privacy laws, and intellectual property infringement claims.
You represent that You are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that You are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of this agreement and, once You accept it, Apple has the right to enforce it against You as a third-party beneficiary.
3. Not medical advice
Vellness is for information only. It is not a medical device and does not diagnose, treat, cure or prevent any condition.
- Values read from scanned reports can be wrong or incomplete. You must check them against your original reports.
- Consult a qualified health professional about your results and before changing any treatment.
- Never ignore or delay professional advice because of something in the Application.
4. Your account
Give accurate information and keep your password secure. You are responsible for activity under your account. Tell us at hi@magicanvas.in if you suspect unauthorised use.
5. Your content
You own the content you add. You give us permission to process it only to provide the service. If you add information about other people, such as family members, you are responsible for having the right to do so.
6. Acceptable use
Do not use Vellness to break the law or infringe anyone's rights, to access other people's accounts or data, or to disrupt or misuse the service.
7. Sharing links
You are responsible for what you share and with whom. Anyone with a link can view what it shows until it expires or you revoke it.
8. Availability and changes
We try to keep Vellness running but do not promise it will always be available or error-free. We may change or discontinue features or the service. Keep your own copies of anything important.
9. Third-party services
Vellness relies on third-party services, such as hosting and e-mail delivery. They have their own terms, and we are not responsible for them. Apple's terms also apply to the Application.
10. Disclaimer and limitation of liability
Vellness is provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows. To that extent, we are not liable for decisions you make based on the Application, for data loss, or for indirect or consequential losses. Nothing in these terms limits liability that cannot be limited by law.
11. Termination and deletion
You can delete your account in the app at any time. We may suspend or close an account for misuse. Your licence ends automatically if you fail to follow these terms.
12. Governing law
These terms are governed by the laws of the State of California, United States. Disputes will be brought in the state or federal courts located in Contra Costa County, California.
13. Changes to the terms
We may update these terms. We will post the new version here and change the date above.
